1. Who this agreement is between
These Terms govern your use of the Weitland web app, mobile apps, and related services (the "Service"). The Service is provided by Felix Feit, c/o COCENTER, Koppoldstr. 1, 86551 Aichach, Germany (the "Operator"). Full contact details are in our Impressum.
By creating an account or otherwise using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. The Service
Weitland lets you draw your property boundary on a map, automatically detect physical features within it, place custom elements, and attach tasks to those locations. We may add, change, or remove features over time. We will not materially reduce the core functionality of a paid plan during a billing period without notice.
3. Your account
You must be at least 16 years old to create an account. You are responsible for keeping your credentials secure. You may not share your account with anyone outside your household or organisation (members of a property are explicitly invited via the team feature).
4. Acceptable use
You agree not to:
- upload content that is illegal, infringing, or harmful;
- attempt to bypass authentication, rate limits, or quotas;
- scrape, mirror, or resell the Service or its data;
- use the Service to track persons without their consent.
5. Your content
You keep ownership of everything you create in Weitland — your property boundary, elements, tasks, comments and attachments. You grant the Operator a limited license to host, transmit and display that content for the sole purpose of providing the Service to you and to anyone you invite. We will not use your content to train models, sell to third parties, or display advertising.
6. Free tier and beta status
The Service is currently offered free of charge during open beta. We reserve the right to introduce paid plans in the future; if and when we do, you will be notified in advance and given the option to export your data and stop using the Service before any charge applies.
7. Availability and warranty disclaimer
We aim for high uptime but do not guarantee uninterrupted service. The Service is provided "as is" and "as available". To the maximum extent permitted by law, the Operator disclaims all implied warranties of merchantability, fitness for a particular purpose and non-infringement.
8. Limitation of liability
Except for damages caused by gross negligence or wilful misconduct, and for liability under the German Product Liability Act (Produkthaftungsgesetz), the Operator's aggregate liability arising from or in connection with the Service is limited to the fees paid by you to the Operator in the twelve (12) months preceding the event giving rise to the claim. Where the Service is offered free of charge, the Operator's liability is limited to direct damages caused by gross negligence or wilful misconduct.
9. Termination
You may delete your account at any time from the in-app settings. We may suspend or terminate accounts that violate these Terms after reasonable notice and an opportunity to cure, except in cases of repeated or material breach.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced in the app and by e-mail to the address on your account. Continued use of the Service after the announced effective date constitutes acceptance of the revised Terms.
11. Governing law and venue
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, mandatory consumer-protection law of your country of residence remains unaffected. Exclusive venue for disputes with merchants, public-law entities and public-law special funds is the court at the Operator's seat (currently Aichach, Germany).
